Park Smart Parking lot use Terms and Conditions

Terms used:

Service Provider- SIA Park Smart, unified registration number 40103639775, VAT Reg. No LV40103639775, registered office: 12 Dzirnieku street, Marupe, Marupe district, Latvia, LV-2167, e-mail address: [email protected], phone +371 20 302 302.

Park Smart Parking lot– paid Parking lot at 12 Dzirnieku street, Marupe, Marupe district, LV-2167, (located at International Airport Rīga, next to VIADA fuel service station), works 24 hours a day all days of the year, where video monitoring is performed for increased safety.

System- Parking lot is equipped with an automatic number plate recognition system, which electronically fixes time of Car entry and departure from Parking lot.

Fee- a fee for using Parking lot must be paid as a prepayment for a foreseen use time according to the Seller’s approved rate (including value-added tax) and payment types specified at www.parksmart.lv. 

Customer- an individual or a legal entity, who paid Fee for using the parking lot at www.parksmart.lv and confirms that is entitled to conclude civil agreements related to Car use, including Parking lot use (lease) agreement, on behalf of Car owner (holder).

Car- a light passenger transport vehicle (the length of the car must not exceed 5.20m) registered with the Road Traffic Safety Directorate of the Republic of Latvia or foreign official institutions with relevant registration plates, the registration number of which was specified by the Customer when making the prepayment. In the event that the customer arrives at the parking lot with a cargo vehicle or light passenger vehicle, the length of which exceeds 5.20 m, then such a car is not allowed in the parking lot and the paid Fee is refunded within 2 bank working days. Camper vans or vehicles with trailers are not serviced.

Car Driver- Customer or Customer’s authorized person, who enters Parking lot by Car. If Car Driver is not a Car owner (holder) during the parking at Parking lot, hereby he/she confirms that he has Car owner’s (holder’s) authorization to use Car.

Service- Car parking at Park Smart Parking lot for Fee.

Terms and Conditions- these Terms and Conditions specify order for using Park Smart Parking lot.

1. When paying Service Provider a Fee at  www.parksmart.lv Customer shall conclude a remote Service agreement and confirm that he/she has read, accepted Terms and Conditions and acknowledged them as binding. Car traffic and parking at Park Smart Parking lot must be performed in accordance with Terms and Conditions, Road Traffic Regulation, road traffic information signs and horizontal marking.

2. When paying a Fee at  www.parksmart.lv Customer shall specify a precise period, for which he/she wishes to park Car at Park Smart Parking lot, Car registration license plate number, name, surname or company name, phone number and e-mail address.

3. Service Provider shall provide for Car a parking place at Park Smart Parking lot for the Customer’s paid period. During the paid period, Car may enter Park Smart Parking lot once and leave during the same period. When arriving to Park Smart Parking lot, Car must be stopped behind the automatic entrance barrier, special video camera fixes Car license plate number, System recognizes and records it in database, thus fixing time of Car entry to Park Smart Parking lot. Simultaneously, automatic barrier opens, and Car may enter Park Smart Parking lot and be parked at a specially marked free parking place. Maximum Car driving speed in the territory of Park Smart Parking lot must not exceed 20 km per hour.

4. Service Provider shall provide free transportation of the mentioned Car Driver, passengers and their luggage from Park Smart Parking lot to Riga International Airport and back by his own transport. To get from the airport back to Park Smart Parking lot, Car Driver must call +371 20 477 477, for free shuttle.

5. After parking a Car at Park Smart Parking lot, Car Driver must make sure that its windows, doors, fuel tank and luggage compartment are hermetically closed and locked, and that Car cannot move during his/her absence. Car registration license plates before entering and leaving Park Smart Parking lot must be cleared of snow and mud, in order for System to recognize them.

6. Car parking at Park Smart Parking lot outside of marked parking places or without observing the marking of parking places shall not be allowed. In case of violating this prohibition, a penalty fee of EUR 50 must be paid. If Car is parked incorrectly, Service Provider may move it to the marked parking place, while Car Driver, additionally to the penalty fee, must reimburse all expenses related to such moving.

7. Smoking, drinking alcoholic drinks and using other intoxicating substances, staying in Car longer than 15 minutes at Park Smart Parking lot is forbidden.

8. Car Driver and Customer shall be jointly liable for their actions or failure to act and consequences thereof resulting in damages to other Park Smart Parking lot users and their property, as well as to Park Smart Parking lot or its employees, according to the valid normative acts of the Republic of Latvia.

9. If actual time of Car presence at Park Smart Parking lot exceeds the prepaid time, Car Driver, before leaving Park Smart Parking lot, must pay operator a Fee for unpaid time according to the Service Provider’s approved rate. Car Driver must specify Car license plate number for operator to calculate a Fee. After making a payment Car must leave Park Smart Parking lot within 15 minutes.

10. When leaving Park Smart Parking lot, Car must be stopped behind the automatic exit barrier, special video camera fixes Car license plate number, System recognizes and records it in database, thus fixing time of Car departure from Park Smart Parking lot. Automatic barrier opens, and Car must leave Park Smart Parking lot.

11. Car Driver shall be liable for Car safety. Service Provider shall not assume any liability for the Car parked at Park Smart Parking lot and keeping and safeguarding property in it.

12. Customer may within fourteen (14) days after conclusion of agreement (making a payment) without specifying a reason decline the Service by sending Service Provider a clear notice, e. g., respectively completed  decline form (download) to [email protected]. In this case, Service Provider promptly and in any case not later than within fourteen (14) days after receiving such decline shall refund the paid Fee to Customer. Refund shall be mad by using the same payment type Customer used, if Customer has not clearly agreed otherwise.

13. If Customer planned to use Service within 14 days after paying a Fee, it is considered that at paying a Fee Customer provided Service Provider with a clear request (according to provisions of clause 18 of Cabinet Regulation No 255 Regulation of a remote agreement of 20.05.2014) to receive Service in the mentioned 14 days period, or decline right period. Customer agrees and confirms that, if Service provision started before the end of decline right period will be fully completed, he/she loses decline right from the day, when Service is fully completed.

14. If Customer uses decline right mentioned in clause 12 of Terms and Conditions after providing request mentioned in clause 13 (according to provisions of clause 23 of Cabinet Regulation No 255 Regulation of a remote agreement of 20.05.2014), Customer must only pay Service Provider an amount, which, in respect of the paid full Fee for the whole period of Service, is proportional to the scope of used Service up to the moment, when Customer informs Service Provider about using the decline right. Service Provider shall pay difference between the paid Fe and the mentioned amount not later than within fourteen (14) days after receiving respective decline.

15. By accepting Terms and Conditions Customer confirms that agrees to processing of data entered at  www.parksmart.lv for the purpose of provision of expected services, as well as for sending actual information of Order, including by using phone and e-mail. Customer’s personal data shall not be given to any third parties without his/her consent, except in cases provided for in normative acts. Service Provider shall not store Customer’s payment system access data and has no access to Customer’s online banking and electronic payment systems, all payment information is directed to website AS Swedbank, 40003074764.

16. Service resale, lease, division or transfer to a third party without Service Provider’s prior written consent is forbidden. Otherwise, Service provision may be suspended, and Customer may face civil liability according to the valid normative acts of the Republic of Latvia.

17. Service Provider may interrupt System operation, if it is necessary for improvement or upgrading, or in case of damages thereof. In such cases Service Provider provides Service to Customer by using Park Smart Parking lot operator.

18. Any questions or disagreements must first be solved with the help of Park Smart Parking lot operator. In case of technical errors or System damages, Park Smart Parking lot operator’s fixed data shall be considered correct.

19. Service Provider may at any time make amendments in Terms and Conditions, which come into effect after publication thereof at  www.parksmart.lv. Service Provider may at his discretion restrict or terminate Customer’s access to  www.parksmart.lv, if Customer violates Terms and Conditions, Service Provider’s instructions or normative acts, or there are justified suspicions of it.

20. Agreement comes into effect from the moment of paying a Fee to the moment specified by Customer at paying a Fee as the term of Service use period, or the moment, when Car actually leaves Park Smart Parking lot, if it has entered it. Service Provider does not store the concluded agreement in paper form. Any disputes are resolved by negotiations, or, in case of disagreements only, in courts of the Republic of Latvia according to the valid normative acts of the Republic of Latvia.
